Effective date: March 25, 2026
Last updated: March 25, 2026
These Terms and Conditions (“Terms”) govern your access to and use of Pixel Pitch (the “Service”), including our website and any mobile application we make available.
The Service is operated by:
- [Legal entity name] (“we,” “us,” or “our”)
Contact:
- Email: [legal or support contact email]
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
1.1 Age. You must be old enough to form a binding contract in your jurisdiction and meet any minimum age for online services in your region (for example, 16+ where EU Member States set that bar for information society services, or 13+ with parental consent where applicable in the United States). The Service is not intended for children under 13.
1.2 No account required for casual play. You may join games with a game code and a display name without creating a registered user account.
2. Description of the Service
2.1 Nature of the Service. Pixel Pitch is a multiplayer, real-time party game in which participants guess prices, compete in mini-games, and see scores and results. Features may include live updates, leaderboards (including optional daily challenges), and product imagery or descriptions used for gameplay.
2.2 Availability. We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features or the Service with reasonable notice where practicable.
2.3 No wagering. The Service is for entertainment only. Unless we expressly enable regulated features in your jurisdiction, nothing on the Service constitutes gambling or a prize promotion requiring a license.
3. Acceptable use
You agree not to:
- Violate any applicable law or regulation.
- Harass, abuse, threaten, or harm other users.
- Use display names, images, or messages that are unlawful, defamatory, obscene, hateful, infringing, or deceptive.
- Attempt to gain unauthorized access to the Service, other users’ sessions, or our systems (including probing, scanning, or exploiting vulnerabilities).
- Interfere with the Service (for example, denial-of-service attacks, excessive automated requests, or attempts to reverse engineer except as permitted by law).
- Scrape, mine, or bulk collect data from the Service without our prior written consent.
- Circumvent rate limits, security controls, or session mechanisms.
- Use the Service to distribute malware or phishing.
- Misrepresent your affiliation with any person or entity.
We may investigate violations and cooperate with law enforcement where appropriate.
4. User content and conduct
4.1 Display names and inputs. You are responsible for content you provide (such as your display name and in-game inputs visible to others). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, and display that content solely to operate and improve the Service (for example, showing scores to other players).
4.2 No obligation to monitor. We are not obligated to monitor user content but may remove or restrict content or users that violate these Terms or that we reasonably believe harm the Service or others.
4.3 Product information. Product names, prices, images, and descriptions are provided for entertainment and informational purposes and may be inaccurate or outdated. We do not warrant that any price or detail matches a retailer’s current offer.
5. Intellectual property
5.1 Our rights. The Service, including software, branding, logos, UI, and original content, is owned by us or our licensors and is protected by intellectual property laws.
5.2 Limited license. We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms.
5.3 Trademarks. “Pixel Pitch” and related marks are our trademarks (or used under license). You may not use them without our prior written permission.
5.4 Third-party materials. Product images and trademarks may belong to third parties and are used for gameplay context. If you are a rights holder and believe content infringes your rights, contact us with sufficient detail to assess the request.
6. Privacy
Our collection and use of personal information is described in the Privacy Policy. By using the Service, you acknowledge that policy.
7. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be secure, free of viruses, or free of errors, or that any defect will be corrected.
Some jurisdictions do not allow certain disclaimers; in those jurisdictions, our warranties are limited to the minimum extent required by law.
A.I. Powered (For Better or Worse)
A.I. is used—generously—for image, music, text snf other content generation. Look, we're not hiding it. We've basically handed the keys to the creative department to a very confident algorithm that may or may not understand what "subtlety" means.
Some of our A.I.-generated content is chef's kiss. Other pieces look like they were created during an existential crisis. But hey, that's kind of the point. In a world obsessed with "authentic," "trending," and "algorithmically curated," we figured we'd lean hard into the chaos of machine-generated creativity.
If you spot something that looks a little off—a weird artifact, a hand with six fingers, text that reads like a fever dream—congratulations! You've just witnessed A.I. in its natural habitat. We call it intentional imperfection. You can call it what you want.
Welcome to Pixel Pitch: where the trends are absurd, the content is AI-assisted, and literally nothing is what it seems.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
-
IN NO EVENT WILL WE OR OUR AFFILIATES, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
-
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (IF ANY), OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
The Service is free to play for end users in typical deployments; where no fees are paid, our aggregate liability is limited to USD $100 unless mandatory law requires otherwise.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum permitted by law.
9. Indemnity
You will defend, indemnify, and hold harmless us and our affiliates, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your content or conduct; or (c) your violation of these Terms or applicable law.
10. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or harms the Service, users, or third parties. You may stop using the Service at any time.
Provisions that by their nature should survive (including Sections 5, 7–9, 11–16) will survive termination.
11. Governing law and disputes
11.1 Governing law. These Terms are governed by the laws of [Jurisdiction — e.g., State, Country], excluding conflict-of-law rules, except where mandatory consumer protection laws of your country of residence apply.
11.2 Venue. Subject to mandatory law, exclusive jurisdiction and venue for disputes will be the courts of [Venue — city/country].
11.3 Informal resolution. Before filing a claim, you agree to contact us at [legal or support contact email] to attempt to resolve the dispute informally for thirty (30) days.
11.4 EU consumers. If you are a consumer in the European Union, you may benefit from mandatory provisions of the law of your country of residence. You may also use the EU Online Dispute Resolution platform if applicable.
11.5 Class actions. To the extent permitted by law, disputes must be brought only on an individual basis, not as a plaintiff or class member in any class or representative proceeding.
12. Export and sanctions
You may not use the Service if you are in a country subject to comprehensive sanctions or if you are listed on any government denied-party list, except as authorized by law.
13. Open-source and third-party software
The Service may include open-source or third-party components subject to their own licenses. Those licenses govern your use of those components where they apply.
14. Changes to the Terms
We may modify these Terms at any time. We will post the updated Terms with a new Effective date. If changes are material, we will provide reasonable notice where required by law (for example, a notice on the Service). Your continued use after the effective date constitutes acceptance of the revised Terms. If you do not agree, stop using the Service.
15. Miscellaneous
15.1 Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service.
15.2 Severability. If any provision is held invalid, the remaining provisions remain in effect.
15.3 No waiver. Failure to enforce any provision is not a waiver.
15.4 Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
15.5 Language. The English version controls unless required otherwise by law.
